Land Use 101 - Quick Summary

At our recent quarterly meeting Sarah Absher, Tillamook County Director of Community Development, presented an overview of Land Use 101 and how the various types of requests are handled by the county. Here is a quick breakdown on the various Types of Land Use Planning Applications they are tracking and when some are presented to the public for comment.

 

Type 1- Basic permits not requiring Public Comment. Ex: Replacement dwelling, Property Line Adjustments, Beach and Dune Hazard Report, Geologic Hazard Report, Extension of Time, etc.

 

Type 2- Variance, Partition & Conditional Use requests – Administrative Review & Decision Made By Director (no hearing) with Public Comment During the 14-Day Public Comment Period stated in the Notice of Application Sent to the CAC, Agencies & Surrounding Property Owners Ex: Farm/Use Review, Conditional Use, Variance, Foredune Grading, Non-Confirming Review, etc.


Type 3- Public Hearing before Tillamook County Planning Commission and (depending on request) also hearings with the Board of County Commissioners.  Public Comment is Received Before Hearing & During Hearing Process.  Planning Commission Decision Ex: Conditional Use, Variances, Subdivisions, Appeal of Directors Decision.  Board of County Commissioner Decision Ex: Appeal of Planning Commission Decision where the Planning Commission is the Decision Maker and Smaller-Scale (individual property) Zone Changes/Map Amendments


Type 4- Public Comment is Received Before Hearing & During Hearing Process.  Ex: Appeal of Planning Commission Decision where Planning Commission is the Decision Maker, and Large Scale Zoning Amendment, Plan and/or Text Amendment (Ex: Community Plan Updates or Creation of New Zoning), etc.  *Planning Commission still holds a hearing on these matters but is not the decision maker.  In these instances, the Planning Commission makes a recommendation of decision to the Board of County Commissioners.
